Our Terms of Service

1.1 Eligibility & Registration

• Age Restrictions: You must be at least 13 years old to use the Services. If you are an EU resident, you must be at least 16 years old. If you do not meet the applicable age requirement, you are not permitted to use the Services.
• Registration: When you create an account, you agree to provide accurate and complete information about yourself. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. If you become aware of any unauthorized use of your account, you must immediately notify Watcher Society at support@watchersociety.com.

1.2 Connecting Social Media Accounts

Watcher Society's Prometheus platform allows you to connect your social media accounts (e.g., Facebook, Twitter/X, LinkedIn, Instagram, YouTube, TikTok, and similar platforms) so that Prometheus can generate and publish content—including comments and replies—on your behalf. By connecting your social media account(s) to the Services, you represent and warrant that you have the right to grant us access to and use of your social media account(s). You further acknowledge and agree that:

1. Consent to Publishing: Prometheus may draft and/or publish text, images, videos, or other posts on your social media account(s) as authorized by you.
2. Compliance with Third-Party Terms: You will comply with all applicable third-party terms of service (e.g., the terms of each social media platform you use through Prometheus).
3. User Responsibility: You are solely responsible for reviewing, approving, or otherwise controlling the content that Prometheus creates or publishes on your behalf. You are also responsible for ensuring any content posted complies with all laws and regulations that apply to you or your business.

1.3 General Practices Regarding Use and Storage

You acknowledge that Watcher Society may set general practices concerning use of the Services, including limits on data storage and retention. Watcher Society may, at its sole discretion and at any time, modify these practices without notice. You agree that Watcher Society has no responsibility or liability for the deletion of, or failure to store or transmit, any content maintained on or transmitted through the Services.

1.4 Email Notifications

By using the Services, you consent to receive notifications electronically, such as via email, to the address you provide. These notifications may concern your account, changes to the Services, marketing messages, or other relevant information.

2.1 No Financial Advice; Educational and Informational Purposes Only

All content, features, charts, indicators, trade signals, Oracle alerts, Watcher Wave strategies, order flow tools, AI copilot responses, educational materials, voice alerts, newsletters, and any other information provided through the Trading Services (collectively, "Trading Content") are provided for general informational and educational purposes only. Trading Content does not constitute, and shall not be construed as, investment advice, financial advice, legal advice, tax advice, accounting advice, a recommendation to buy or sell any security or financial instrument, a solicitation of an offer to buy or sell any security or financial instrument, or an endorsement of any trading strategy.

Watcher Society is not a registered broker-dealer, investment adviser, commodity trading advisor (CTA), commodity pool operator (CPO), futures commission merchant (FCM), introducing broker, swap dealer, or financial planner with any regulator in any jurisdiction. No content on the Services creates any fiduciary, advisory, or agency relationship between you and Watcher Society. You should not rely on any Trading Content as the sole basis for any trading or investment decision. Before making any trading decision, you should consult with a qualified, independent, and licensed financial professional, tax advisor, or legal counsel regarding your personal circumstances.

2.2 Risk of Loss; Leverage Warning

Trading futures, options, equities, foreign exchange, cryptocurrencies, and other financial instruments carries a high degree of risk and is not suitable for every investor. You could lose some or all of the capital you allocate to trading. For leveraged products, including but not limited to futures contracts, options, margin accounts, and contracts-for-difference, you may lose more than the amount you initially deposited or risked. Losses may accumulate rapidly, and market movements may trigger margin calls, forced liquidations, or broker-initiated account closures without warning.

You expressly acknowledge that:

• Past performance of any trading strategy, signal, indicator, or instrument is not indicative of, and does not guarantee, future results.
• Hypothetical, simulated, paper, or backtested performance results have inherent limitations and do not reflect actual trading.
• Market conditions, volatility, liquidity, slippage, news events, macroeconomic shocks, overnight gaps, exchange halts, and price dislocations can produce outcomes that differ materially from historical patterns or analytical projections.
• You should only trade with capital you can afford to lose in its entirety.

2.3 User Responsibility for Trading Decisions

You are solely and exclusively responsible for any and all trading decisions, orders, positions, entries, exits, stop losses, take profits, position sizes, instruments selected, leverage elected, and risk parameters configured through the Services. Watcher Society does not exercise discretion over your account, does not execute trades on your behalf, and does not guarantee any specific outcome.

By using the Trading Services, you represent and warrant that:

• You have the financial means, knowledge, and experience necessary to understand the risks of trading the instruments you select.
• You have evaluated your own investment objectives, risk tolerance, time horizon, and financial situation, and have determined that trading is appropriate for you.
• You have consulted with qualified, independent financial, legal, and tax professionals as you deem necessary prior to trading.
• You are not relying on Watcher Society, its employees, its affiliates, or any Trading Content as a substitute for independent judgment or professional advice.
• You will comply with all applicable laws, regulations, exchange rules, and tax obligations in your jurisdiction.

2.4 Broker Integrations and Third-Party Execution

The Trading Services may integrate with third-party brokers, broker-routing platforms, and order management systems, including but not limited to TradersPost and any brokerage accounts linked through it (collectively, "Third-Party Brokers"). Third-Party Brokers are independent entities not owned, operated, or controlled by Watcher Society. Your relationship with any Third-Party Broker is governed by a separate agreement between you and that broker.

Watcher Society is not a broker-dealer, FCM, or executing party. Watcher Society does not hold customer funds, does not custody securities or futures positions, does not clear or settle trades, and does not guarantee execution of any order. Orders routed through the Services are transmitted to the Third-Party Broker for execution; Watcher Society's role is limited to signal generation, order formatting, and transmission on a best-efforts basis.

You acknowledge and accept that Watcher Society is not responsible or liable for, and you release Watcher Society from any claim arising out of or related to:

• Broker outages, downtime, maintenance windows, or unavailability of broker APIs.
• Rejected, partially filled, late, duplicated, or missed orders caused by Third-Party Brokers.
• Execution slippage, adverse fills, price improvements, or price dislocations at the broker.
• Margin calls, forced liquidations, or broker-initiated account closures.
• Broker account suspension, termination, or regulatory enforcement actions.
• Errors in data transmitted by a Third-Party Broker (including balances, positions, fills, and order status).
• Fees, commissions, exchange fees, regulatory fees, or financing costs charged by the Third-Party Broker.
• Any loss, damage, or missed opportunity arising from broker-side latency, outages, or failures.

You are responsible for independently verifying all fills, positions, balances, and account activity directly with your Third-Party Broker, and for promptly reporting any discrepancies to the broker.

2.5 Market Data Accuracy, Delay, and Availability

Market data displayed in the Services — including but not limited to real-time and delayed quotes, historical bars, tick data, order book depth, settlement prices, volume, and derived indicators — is provided by third-party data vendors (including, without limitation, DataBento and CME-sourced feeds). Market data is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied.

You expressly acknowledge and accept that:

• Market data may be delayed, interrupted, stale, incomplete, inaccurate, or reflect contract-mapping or symbol-mapping errors.
• Watcher Society does not guarantee the accuracy, timeliness, continuity, completeness, or uninterrupted availability of any market data.
• The Services may be unavailable or degraded at any time, including during regular market hours, pre-market and post-market sessions, maintenance windows, high-volatility events, CME holidays, exchange outages, or third-party vendor outages.
• Watcher Society does not provide any service-level agreement (SLA) or uptime guarantee for the Trading Services.
• Trading decisions made in reliance on delayed, inaccurate, or incomplete data are made at your own risk, and Watcher Society disclaims any liability for losses resulting from data errors, delays, or outages.

2.6 Paper Trading, Replay Mode, and Simulated Results

The Services may offer paper trading, simulated trading, and historical replay modes (collectively, "Simulated Trading") for education, practice, and strategy evaluation. Simulated Trading does not involve real money, real orders, or real broker execution.

Simulated Trading results do not guarantee, predict, forecast, or correlate with the results you would experience in live trading. Simulated Trading has inherent limitations that make it fundamentally different from live trading, including but not limited to:

• Absence of real slippage, latency, partial fills, and liquidity constraints.
• Absence of real emotional and psychological factors (stress, fear, greed, loss aversion, overtrading).
• Idealized fill assumptions that would not occur in live market conditions.
• Hindsight bias in historical replay — the outcome is already known, even if the interface hides it.
• No real counterparty risk, no real broker risk, and no real margin consequences.

Transitioning from Simulated Trading to live trading activates real financial risk. You are solely responsible for deciding when (or whether) to transition, and for accepting the resulting risk of real capital loss. Any performance statistics, win rates, equity curves, or P&L figures derived from Simulated Trading must not be presented, distributed, or relied upon as an indication of live trading performance.

2.7 Oracle Signals, Watcher Wave Indicators, and Automated Alerts

The Services may include algorithmically or AI-generated trading signals, alerts, indicators, strategies, and notifications, including but not limited to Oracle trading signals, Watcher Wave indicators, Watcher Wave Gann Edition, Watcher Citadel strategies, AI copilot output, and voice or audio alerts (collectively, "Signals"). Signals are informational and educational only.

Signals are not:

• Investment recommendations, solicitations, or offers to buy or sell.
• Guarantees of future performance, profit, or any specific outcome.
• Personalized financial advice tailored to your individual circumstances.
• A substitute for your own independent research, judgment, and decision-making.

You are solely responsible for evaluating any Signal, deciding whether to act on it, determining position sizing and risk parameters, and executing any resulting trade. Watcher Society makes no representation or warranty regarding the accuracy, profitability, reliability, or timeliness of any Signal, and disclaims any liability arising from your reliance on any Signal.

2.8 Automated and Algorithmic Order Management

The Trading Services may include features for automated order routing, bracket orders, trailing stops, engine-gated limit entries, scheduled orders, and other forms of automated order management (collectively, "Automation Features"). Automation Features may submit, modify, or cancel orders with your broker without further user intervention once configured.

You acknowledge and accept that:

• You remain solely responsible for all orders submitted through Automation Features, including orders triggered while you are not actively monitoring the Services.
• Automation Features depend on accurate market data, stable connectivity, uninterrupted broker APIs, correct user configuration, and the continuous availability of the Watcher Society infrastructure — any of which may fail without warning.
• Automation failures, misconfigurations, software bugs, connectivity loss, broker disconnections, or unexpected market conditions may result in orders not being placed, orders being placed incorrectly, duplicated orders, missed exits, unprotected positions, or other adverse outcomes.
• You are responsible for monitoring your positions and orders independently and for intervening manually with your broker if needed.
• Watcher Society disclaims any liability for losses, missed opportunities, or adverse outcomes arising from the use, misuse, failure, or unexpected behavior of any Automation Feature.

2.9 Eligibility and Regulatory Compliance

Trading Services are made available only to users for whom such use is lawful in their jurisdiction. By using the Trading Services, you represent and warrant that:

• You are of legal age to enter into a binding contract and to trade the instruments you select in your jurisdiction.
• You are not a resident of, or physically located in, any jurisdiction where the use of the Trading Services is prohibited, restricted, or subject to licensing requirements that Watcher Society has not satisfied.
• You are not a person with whom U.S. persons are prohibited from dealing under OFAC sanctions, export controls, or applicable anti-money-laundering laws.
• You will comply with all applicable laws, regulations, exchange rules, tax obligations, and reporting requirements in your jurisdiction, including those governing securities, futures, commodities, and cryptocurrencies.
• You will not use the Trading Services in any manner that could cause Watcher Society to violate any applicable law or regulation.

Watcher Society reserves the right to restrict, suspend, or terminate access to any Trading Service, in whole or in part, at any time and without notice, for any user, jurisdiction, or instrument.

3.1 User Conduct

You agree that you are solely responsible for any content (including text, images, videos, and any other information or materials) you submit or publish through the Services, either directly or by using the Services to post on your connected social media accounts. You further agree that you will not:

We reserve the right (but have no obligation) to review, remove, or modify content, and to investigate or take appropriate action against anyone who, in our sole discretion, violates these Terms. This may include removing or modifying content, terminating or suspending your account, or reporting you to law enforcement authorities.

4.1 Your Content

• Ownership: You retain whatever ownership rights you have in the content you post or submit through the Services or through your connected social media accounts.
• License to Us: By submitting or posting content through our Services, you grant us a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, display, copy, modify (for technical purposes, e.g., reformatting), and otherwise use your content solely for the purpose of providing and improving the Services.

4.2 Watcher Society Content and Software

All content, trademarks, service marks, and logos on the Services that are not user-generated (collectively, "Watcher Society Materials") are the property of Watcher Society, LLC or its licensors and are protected by intellectual property laws. You are granted a limited, nontransferable license to access and use the Services. You agree that you will not reproduce, distribute, modify, or create derivative works of any Watcher Society Materials without our express written permission.

4.3 Feedback

Any feedback, comments, or suggestions ("Feedback") you provide regarding the Services is entirely voluntary. We may use such Feedback for any purpose without obligation or compensation to you.

Entire Agreement

These Terms constitute the entire agreement between you and Watcher Society regarding the Services and supersede all prior agreements regarding the Services.

Choice of Law

These Terms will be governed by and construed under the laws of the State of Arizona without regard to its conflicts of laws principles. Subject to the arbitration provisions above, any disputes relating to these Terms shall be brought in the state or federal courts located in Coconino County, Arizona.

Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties agree that the remaining provisions will remain in full force and effect.

No Waiver

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely without restriction.

Notices

We may provide notices to you by email, regular mail, or postings on the Services.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we do, we will post the updated Terms and indicate the date of the latest revision. Changes will become effective 14 days after posting (or immediately if made for legal reasons or relating to new features). Your continued use of the Services after the effective date of any modification constitutes your acceptance of the updated Terms.
